Ko\u015bciuszki 94<br\/>34-530 Bukowina Tatrza\u0144ska, Poland<br\/>KRS: 0000929690<br\/>NIP: 7361738044<br\/>REGON: 520303494 <\/p>\n\n<p class=\"wp-block-paragraph\">hereinafter referred to as the &#8220;Controller&#8221;.<\/p>\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li>The Controller can be contacted:<\/li>\n<\/ol>\n\n<ul class=\"wp-block-list\">\n<li>by traditional mail at the Controller&#8217;s registered address;<\/li>\n\n\n\n<li>by email at: <strong><a href=\"mailto:manager@schroniskobukowina.pl\">manager@schroniskobukowina.pl<\/a><\/strong>;<\/li>\n\n\n\n<li>by phone at: <strong>+48 455 450 048<\/strong>.<\/li>\n<\/ul>\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li>The Controller processes personal data in accordance with applicable regulations, in particular in accordance with:<\/li>\n<\/ol>\n\n<ul class=\"wp-block-list\">\n<li>Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016, hereinafter referred to as &#8220;GDPR&#8221;;<\/li>\n\n\n\n<li>the Act of 10 May 2018 on the protection of personal data; <\/li>\n\n\n\n<li>the Act of 12 July 2024 \u2013 Electronic Communications Law. <\/li>\n<\/ul>\n\n<ol start=\"5\" class=\"wp-block-list\">\n<li>The Website is informational and contact-oriented. It does not facilitate online sales, user account creation, or online payments. <\/li>\n<\/ol>\n\n<h2 class=\"wp-block-heading\">\u00a7 2. Scope of Collected Data <\/h2>\n\n<ol class=\"wp-block-list\">\n<li>The Controller may process personal data provided by the User via the contact form, email, telephone, or other available communication channels.<\/li>\n\n\n\n<li>Depending on the method of contact and the nature of the matter, the following may be processed in particular:<\/li>\n<\/ol>\n\n<ul class=\"wp-block-list\">\n<li>first and last name;<\/li>\n\n\n\n<li>email address;<\/li>\n\n\n\n<li>phone number;<\/li>\n\n\n\n<li>company or organization name;<\/li>\n\n\n\n<li>data relating to group reservations, including the number of Guests and the planned visit date;<\/li>\n\n\n\n<li>information regarding interest in catering, collaboration, marketing, or other services;<\/li>\n\n\n\n<li>message content and other information voluntarily provided by the User;<\/li>\n\n\n\n<li>data contained in further correspondence with the Controller.<\/li>\n<\/ul>\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li>While using the Website, technical and navigational data may be automatically collected, such as:<\/li>\n<\/ol>\n\n<ul class=\"wp-block-list\">\n<li>device IP address;<\/li>\n\n\n\n<li>date and time of entry to the Website;<\/li>\n\n\n\n<li>information about the web browser and operating system;<\/li>\n\n\n\n<li>device type;<\/li>\n\n\n\n<li>visited subpages;<\/li>\n\n\n\n<li>address of the page from which the User was redirected to the Website;<\/li>\n\n\n\n<li>information about errors and technical events;<\/li>\n\n\n\n<li>identifiers stored in cookies or similar technologies.<\/li>\n<\/ul>\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li>The Controller does not, as a rule, require the provision of special categories of personal data, including health data.<\/li>\n\n\n\n<li>If the User voluntarily provides information regarding allergies, food intolerances, or other health circumstances in order to have them taken into account when making a group reservation, preparing a menu, or providing a catering or gastronomic service, such data may be processed on the basis of the User&#8217;s explicit consent, in accordance with Article 9(2)(a) GDPR.  <\/li>\n\n\n\n<li>The User should only provide data necessary to handle the given matter. The User should not provide personal data of other individuals unless authorized to do so and has informed those individuals about the transfer of their data to the Controller. <\/li>\n<\/ol>\n\n<h2 class=\"wp-block-heading\">\u00a7 3. Purposes and Legal Bases for Data Processing <\/h2>\n\n<ol class=\"wp-block-list\">\n<li>Personal data may be processed for the following purposes:<\/li>\n<\/ol>\n\n<h3 class=\"wp-block-heading\">1) Handling the contact form, email messages, and telephone contact<\/h3>\n\n<p class=\"wp-block-paragraph\">Data is processed in order to receive an inquiry, provide a response, conduct correspondence, and handle the matter to which the contact relates.<\/p>\n\n<p class=\"wp-block-paragraph\">The legal basis is:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Article 6(1)(b) GDPR \u2013 if the contact relates to the conclusion or performance of a contract or taking steps at the request of the User prior to entering into a contract;  <\/li>\n\n\n\n<li>Article 6(1)(f) GDPR \u2013 the Controller&#8217;s legitimate interest in conducting communication, providing responses, and handling inquiries.  <\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">2) Handling group reservations<\/h3>\n\n<p class=\"wp-block-paragraph\">Data is processed in order to receive and handle a group reservation, contact the person making the reservation, determine the number of Guests, the date, menu, and other conditions of the visit.<\/p>\n\n<p class=\"wp-block-paragraph\">The legal basis is Article 6(1)(b) GDPR, i.e., taking steps at the request of the data subject prior to entering into a contract and performance of a contract.  <\/p>\n\n<h3 class=\"wp-block-heading\">3) Handling inquiries regarding catering and collaboration<\/h3>\n\n<p class=\"wp-block-paragraph\">Data is processed in order to present an offer, determine the User&#8217;s needs, prepare a quote, conduct negotiations, and conclude and perform a contract.<\/p>\n\n<p class=\"wp-block-paragraph\">The legal basis is:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Article 6(1)(b) GDPR \u2013 taking steps prior to entering into a contract or performance of a contract;  <\/li>\n\n\n\n<li>Article 6(1)(f) GDPR \u2013 the Controller&#8217;s legitimate interest in developing business activities and conducting business contacts.  <\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">4) Fulfillment of legal obligations<\/h3>\n\n<p class=\"wp-block-paragraph\">Data may be processed in order to fulfill obligations arising from legal provisions, in particular tax, accounting, and archiving obligations.<\/p>\n\n<p class=\"wp-block-paragraph\">The legal basis is Article 6(1)(c) GDPR.  <\/p>\n\n<h3 class=\"wp-block-heading\">5) Establishment, pursuit, or defense of claims<\/h3>\n\n<p class=\"wp-block-paragraph\">Data may be processed in order to establish, pursue, or defend against claims related to the use of the Website, correspondence conducted, reservations, or services provided.<\/p>\n\n<p class=\"wp-block-paragraph\">The legal basis is Article 6(1)(f) GDPR, i.e., the Controller&#8217;s legitimate interest in protecting its rights.  <\/p>\n\n<h3 class=\"wp-block-heading\">6) Ensuring the operation and security of the Website<\/h3>\n\n<p class=\"wp-block-paragraph\">Technical data, including IP addresses and data stored in server logs, may be processed in order to:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>ensure the proper operation of the Website;<\/li>\n\n\n\n<li>diagnose technical problems;<\/li>\n\n\n\n<li>protect against attacks, abuse, and malicious software;<\/li>\n\n\n\n<li>detect unauthorized access attempts;<\/li>\n\n\n\n<li>create backups;<\/li>\n\n\n\n<li>administer the Website.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The legal basis is Article 6(1)(f) GDPR, i.e., the Controller&#8217;s legitimate interest in ensuring the security and proper functioning of the Website.  <\/p>\n\n<h3 class=\"wp-block-heading\">7) Conducting statistics and analyzing the use of the Website<\/h3>\n\n<p class=\"wp-block-paragraph\">If the User consents to analytical cookies, data may be processed in order to create statistics, study traffic on the Website, and improve its functionality and content.<\/p>\n\n<p class=\"wp-block-paragraph\">The legal basis is Article 6(1)(a) GDPR, i.e., the User&#8217;s consent.  <\/p>\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li>If the basis for processing is consent, the User may withdraw it at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before its withdrawal. <\/li>\n\n\n\n<li>Providing data is voluntary, but may be necessary to obtain a response, accept a group reservation, prepare an offer, or conclude and perform a contract.<\/li>\n\n\n\n<li>Failure to provide data marked as required may prevent the form from being sent or the matter from being handled.<\/li>\n<\/ol>\n\n<h2 class=\"wp-block-heading\">\u00a7 4. Recipients of Personal Data <\/h2>\n\n<ol class=\"wp-block-list\">\n<li>Personal data may be transferred to entities supporting the Controller in operating the Website and the restaurant&#8217;s activities, in particular:<\/li>\n<\/ol>\n\n<ul class=\"wp-block-list\">\n<li>hosting and server service providers;<\/li>\n\n\n\n<li>email and communication tool providers;<\/li>\n\n\n\n<li>entities providing IT, maintenance, and administrative services;<\/li>\n\n\n\n<li>providers of systems handling online forms;<\/li>\n\n\n\n<li>providers of tools for managing cookie consents;<\/li>\n\n\n\n<li>providers of analytical or marketing tools \u2013 only to the extent resulting from User consents;<\/li>\n\n\n\n<li>entities providing accounting, legal, advisory, or audit services;<\/li>\n\n\n\n<li>entities providing services related to the organization of catering or an event, if necessary to provide the ordered service.<\/li>\n<\/ul>\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li>Entities processing data on behalf of the Controller act on the basis of concluded contracts and in accordance with its instructions, unless they independently determine the purposes and methods of processing as separate controllers.<\/li>\n\n\n\n<li>Data may also be disclosed to courts, law enforcement agencies, tax authorities, and other authorized public bodies if the obligation to disclose them arises from legal provisions.<\/li>\n<\/ol>\n\n<h2 class=\"wp-block-heading\">\u00a7 5. Transfer of Data Outside the European Economic Area <\/h2>\n\n<ol class=\"wp-block-list\">\n<li>The Controller primarily uses providers with registered offices within the European Economic Area.<\/li>\n\n\n\n<li>In connection with the use of certain IT, analytical, social, or communication tools, data may be transferred to countries outside the European Economic Area.<\/li>\n\n\n\n<li>If such a transfer occurs, it takes place in accordance with Chapter V of the GDPR, in particular on the basis of:<\/li>\n<\/ol>\n\n<ul class=\"wp-block-list\">\n<li>a European Commission decision establishing an adequate level of protection;<\/li>\n\n\n\n<li>standard contractual clauses approved by the European Commission;<\/li>\n\n\n\n<li>other safeguards provided for by the GDPR.<\/li>\n<\/ul>\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li>Information about specific providers using cookies or similar technologies is available in the cookie settings panel on the Website.<\/li>\n<\/ol>\n\n<h2 class=\"wp-block-heading\">\u00a7 6. Data Retention Period <\/h2>\n\n<ol class=\"wp-block-list\">\n<li>Data related to handling an inquiry is retained for the period necessary to provide a response and complete the matter being handled.<\/li>\n\n\n\n<li>If correspondence leads to the conclusion of a contract, making a group reservation, or providing a service, data is retained for the duration of the contract&#8217;s performance, and then for the period required by legal provisions or until the expiration of the limitation period for claims.<\/li>\n\n\n\n<li>Data processed on the basis of legitimate interest is retained until that interest is realized, an objection is successfully raised, or the limitation period for claims expires.<\/li>\n\n\n\n<li>Data processed on the basis of consent is retained until its withdrawal, achievement of the processing purpose, or determination that the data is no longer needed.<\/li>\n\n\n\n<li>After withdrawal of consent, the Controller may retain information necessary to demonstrate that consent was previously given, for the period needed to protect against potential claims.<\/li>\n\n\n\n<li>Accounting, tax, and settlement documentation is retained for the period resulting from applicable legal provisions.<\/li>\n\n\n\n<li>Technical data and server logs are retained for the period necessary to ensure security, diagnose errors, and ensure the proper functioning of the Website.<\/li>\n\n\n\n<li>Data will be deleted or anonymized when further retention is no longer necessary or justified by applicable regulations.<\/li>\n<\/ol>\n\n<h2 class=\"wp-block-heading\">\u00a7 7. In cases provided for by the GDPR, this period may be extended by an additional two months. <\/li>\n\n\n\n<li>A person who believes that their data is being processed unlawfully has the right to lodge a complaint with:<\/li>\n<\/ol>\n\n<p class=\"wp-block-paragraph\"><strong>President of the Personal Data Protection Office<\/strong><br\/>ul. Automated Decision-Making <\/h2>\n\n<ol class=\"wp-block-list\">\n<li>The Controller does not make decisions concerning Users based solely on automated processing that would produce legal effects or similarly significantly affect the User.<\/li>\n\n\n\n<li>If the User consents to analytical or marketing cookies, the collected data may be used to create statistics or assign the User to general audience groups. These activities do not result in decisions being made concerning the User that produce legal effects. <\/li>\n<\/ol>\n\n<h2 class=\"wp-block-heading\">\u00a7 11. Data Security <\/h2>\n\n<ol class=\"wp-block-list\">\n<li>The Controller applies appropriate technical and organizational measures to protect personal data against loss, destruction, unauthorized access, disclosure, or alteration.<\/li>\n\n\n\n<li>The connection to the Website is secured using SSL\/TLS encryption protocol.<\/li>\n\n\n\n<li>Access to personal data is granted only to authorized persons and entities for whom access is necessary to perform assigned tasks.<\/li>\n\n\n\n<li>The User should remember that transmitting information via the Internet does not ensure complete security.
