This Privacy Policy aims to inform users fairly and transparently about the principles of processing their personal data.  <\/p>\n\n<p class=\"wp-block-paragraph\">The application is designed to serve customers of the <strong>Schronisko Bukowina<\/strong> restaurant, located at ul. Ko\u015bciuszki 94, 34-530 Bukowina Tatrza\u0144ska, and applies exclusively to this single catering establishment. <br\/><\/p>\n\n<h2 class=\"wp-block-heading\"><strong>1. Scope of Processed Data<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">In connection with the use of the Application, the following personal data of users are processed:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>first and last name,<\/li>\n\n\n\n<li>phone number,<\/li>\n\n\n\n<li>email address.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">This data is provided during account registration in the Application.<br\/><br\/><strong>4. Purposes and Legal Bases for Data Processing<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">The legal basis for processing personal data varies depending on the situations described below:<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>If you install and use our mobile application<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">We process your personal data to:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>ensure the proper functioning of the application,<\/li>\n\n\n\n<li>monitor traffic and verify how the application is used,<\/li>\n\n\n\n<li>possibly counteract activities inconsistent with generally applicable legal provisions.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The legal basis for data processing in this regard is Article 6(1)(f) of the Regulation, which allows data processing when it is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, whereby the legitimate interest of the controller in this case is to ensure the proper functioning of the application, conduct statistics on application usage, and prevent fraud and violations of legal provisions.  <br\/><br\/><strong>If you contact us regarding the use of our application<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">We process your personal data to contact you and exchange messages.<\/p>\n\n<p class=\"wp-block-paragraph\">The legal basis for data processing in this regard is Article 6(1)(f) of the Regulation, which allows data processing when it is necessary for the purposes of the legitimate interests pursued by the controller or by a third party. The legitimate interest of the controller in this case is the necessity to process data in order to contact individuals and provide them with answers to their questions.   <\/p>\n\n<p class=\"wp-block-paragraph\"><br\/>We process your personal data to:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>create and manage a user account in the Application.<br\/><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The legal basis for processing personal data in the above scope is <strong>Article 6(1)(b) of the GDPR<\/strong>, i.e., processing necessary for the performance of the Application usage agreement and for the implementation of its functionalities, to which the user is a party. <\/p>\n\n<p class=\"wp-block-paragraph\">Furthermore, personal data may be processed for the purpose of:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>fulfilling legal obligations incumbent on the Controller arising from generally applicable legal provisions, particularly in the scope of accounting and tax documentation, in cases where this data is processed in connection with sales in the catering establishment<br\/>\u2013 based on <strong>Article 6(1)(c) of the GDPR<\/strong>.<br\/><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Personal data may also be processed for the purpose of:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>establishing, pursuing, or defending against potential claims related to the use of the Application or granted discounts,<br\/><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">which constitutes a legitimate interest of the Controller, and the legal basis for data processing in this regard is <strong>Article 6(1)(f) of the GDPR<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\"><strong>4.1. Using the Application<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">Personal data is processed to:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>ensure the proper functioning of the Application,<\/li>\n\n\n\n<li>manage the user account,<\/li>\n\n\n\n<li>assign the appropriate discount.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The legal basis for processing is Article 6(1)(b) of the GDPR (Application Regulations).  <\/p>\n\n<p class=\"wp-block-paragraph\">Personal data is processed to:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>assign the user to the correct group,<\/li>\n\n\n\n<li>confirm eligibility for a given discount,<\/li>\n\n\n\n<li>implement granted benefits.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The legal basis for data processing is Article 6(1)(b) of the GDPR.  <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>4.2. Communication and Inquiry Handling<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">If a user contacts the Controller, personal data is processed to provide a response and conduct correspondence.<\/p>\n\n<p class=\"wp-block-paragraph\">The legal basis for processing is Article 6(1)(f) of the GDPR \u2013 the legitimate interest of the Controller consisting in handling user inquiries.  <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>4.3. SMS and push notifications<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">With the user&#8217;s separate consent, personal data (phone number, account identifier) may be used to send:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>SMS notifications,<\/li>\n\n\n\n<li>push notifications<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">containing information about promotions, events, and the restaurant&#8217;s offer.<\/p>\n\n<p class=\"wp-block-paragraph\">The legal basis for processing is Article 6(1)(a) of the GDPR (consent).  <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>4.4. Analytics<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">The Application uses analytical tools to analyze how the Application is used and for its further development and optimization.<\/p>\n\n<p class=\"wp-block-paragraph\">The legal basis for data processing in this regard is Article 6(1)(f) of the GDPR \u2013 the legitimate interest of the Controller.  <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>[to be completed with analytical tools] <\/strong><\/p>\n\n<h2 class=\"wp-block-heading\"><strong>5. Recipients of Personal Data<\/strong><strong><br\/><\/strong><strong><br\/><\/strong><strong>To properly provide our services, we use the help of third parties. Therefore, the data you provide may be transferred to:<\/strong><strong><br\/><\/strong><strong><br\/><\/strong><strong>a) Entities providing server and hosting services for us:<\/strong><\/h2>\n\n<ul class=\"wp-block-list\">\n<li>SMS message delivery service providers &#8211; Sinch &#8211; <a href=\"https:\/\/sinch.com\/\" target=\"_blank\" rel=\"noopener\">https:\/\/sinch.com\/<\/a> <\/li>\n\n\n\n<li>server infrastructure and hosting providers &#8211; Hetzner &#8211; <a href=\"https:\/\/www.hetzner.com\/\" target=\"_blank\" rel=\"noopener\">https:\/\/www.hetzner.com<\/a><\/li>\n\n\n\n<li>push notification system providers &#8211; OneSignal &#8211; <a href=\"https:\/\/onesignal.com\/\" target=\"_blank\" rel=\"noopener\">https:\/\/onesignal.com<\/a><\/li>\n\n\n\n<li>analytical tool providers &#8211; PostHog &#8211; <a href=\"https:\/\/eu.posthog.com\/signup\" target=\"_blank\" rel=\"noopener\">https:\/\/eu.posthog.com\/signup<\/a><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">These entities process data based on concluded data processing agreements.<\/p>\n\n<p class=\"wp-block-paragraph\">b) entities providing analytical and cloud services, as well as services related to Google Play platform management \u2013 Google Ireland Limited, Gordon House Barrow Street Dublin 4, Ireland, Google Cloud Poland Sp. z o.o. with its registered office in Warsaw (ul. Emilii Plater 53 00-113 Warsaw) and Google LLC with its registered office in Mountain View, California, USA, <\/p>\n\n<p class=\"wp-block-paragraph\">c) entities responsible for the operation of the Apple App Store platform \u2013 Apple Distribution International Ltd. Dublin, Ireland and Apple Inc. with its registered office in Cupertino, California,  <\/p>\n\n<p class=\"wp-block-paragraph\">Due to the possibility of personal data processing by entities such as Google or Apple, your personal data may be subject to transfer outside the European Economic Area. The legal basis for transferring data to the USA is the Data Privacy Framework Program, approved by the European Commission (applies to: Google) or an agreement containing Standard Contractual Clauses, approved by the European Commission (applies to: Apple). <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>6. Data Retention Period<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\"><strong>Personal data is stored for a period of:<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>[to be completed]<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>After this period, the data is deleted or anonymized.<\/strong><strong><br\/><\/strong><\/p>\n\n<h2 class=\"wp-block-heading\"><strong>7. User Rights<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">In connection with the processing of your personal data, you have the following rights:<br\/><br\/><strong>Right of access<\/strong><strong><br\/><\/strong>You can request confirmation from us that your personal data is being processed and obtain relevant information on this matter, including what data is being processed and for what purpose.<br\/><br\/><strong>Right to rectification<\/strong><strong><br\/><\/strong>You have the right to request the immediate rectification of inaccurate personal data and the completion of incomplete personal data.<br\/><br\/><strong>Right to erasure<\/strong><strong><br\/><\/strong>You have the right to request the immediate erasure of personal data if one of the following circumstances applies:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>personal data is no longer necessary for the purposes for which it was collected or otherwise processed;<\/li>\n\n\n\n<li>you withdraw consent (if processing is based on it) and there is no other legal basis for processing;<\/li>\n\n\n\n<li>you have objected to the processing and there are no overriding legitimate grounds for the processing;<\/li>\n\n\n\n<li>personal data has been unlawfully processed;<\/li>\n\n\n\n<li>personal data must be erased for compliance with a legal obligation;<\/li>\n\n\n\n<li>personal data has been collected in relation to the offer of information society services to a child.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>Right to restriction of processing<\/strong><strong><br\/><\/strong>You have the right to request the restriction of personal data processing if:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>you contest the accuracy of the personal data;<\/li>\n\n\n\n<li>the processing is unlawful, but you oppose the erasure of the personal data and request the restriction of their use instead;<\/li>\n\n\n\n<li>we no longer need the personal data for the purposes of the processing, but they are required by you for the establishment, exercise, or defense of legal claims;<\/li>\n\n\n\n<li>you have objected to the processing of data.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>Right to data portability<\/strong><strong><br\/><\/strong>You have the right to receive the personal data concerning you in a structured, commonly used, and machine-readable format and to transmit those data to another controller, if the processing is based on consent or on a contract and is carried out by automated means.<\/p>\n\n<p class=\"wp-block-paragraph\">You also have the right to request that these data be transmitted directly by us to another controller, where technically feasible.<br\/><br\/><strong>Right to lodge a complaint<\/strong><strong><br\/><\/strong>You have the right to lodge a complaint regarding unlawful processing of personal data with the supervisory authority \u2013 the President of the Personal Data Protection Office (to the address of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw).<br\/><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Right to object<\/strong><strong><br\/><\/strong>You have the right to object to processing where processing is based on our legitimate interest.<\/p>\n\n<p class=\"wp-block-paragraph\">These rights can be exercised by contacting the Controller via email. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Data stored on your device<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">In connection with the operation of our mobile application, we may store information containing personal data on your device, such as IP address, application usage history, information about your participation in the loyalty program, or information about your device or software. This data ensures the proper functioning of the application, is used to control traffic, create statistics on application usage by its users, undertake marketing activities, prevent errors and technical malfunctions, ensure website security, and prevent abuse and legal violations. <\/p>\n\n<p class=\"wp-block-paragraph\">This information is stored on your device and you can delete it at any time using the appropriate settings available on your device. The storage of this information is based on your consent, expressed in accordance with Article 173 \u00a7 1 of the Telecommunications Law. We indicate that the lack of such consent or subsequent deletion of data files may result in the inability to use the application&#8217;s functionalities or limitations in its operation.   <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>8. Automated Decision-Making<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">Users&#8217; personal data is not used for automated decision-making that produces legal effects, including profiling within the meaning of Article 22 of the GDPR. <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>9. Data Security<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">The Controller applies appropriate technical and organizational measures to protect personal data against loss, unauthorized access, or disclosure.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>10. Changes to the Privacy Policy<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">The Controller reserves the right to make changes to this Privacy Policy. The current version of the document is available in the Application. <\/p>\n\n<p class=\"wp-block-paragraph\">Last updated: <strong>2025-12-16<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\"><br\/>Application Regulations <br\/>Regulations of the &#8220;Schronisko Bukowina&#8221; mobile application<\/p>\n\n<h2 class=\"wp-block-heading\">\u00a71. General Provisions <\/h2>\n\n<ol class=\"wp-block-list\">\n<li>These Regulations define the rules for using the &#8220;Schronisko Bukowina&#8221; mobile application (hereinafter: &#8220;Application&#8221;).<\/li>\n\n\n\n<li>The Application is operated by TATRY WYSOKIE \u0141UKASZ ZADYLAK SP\u00d3\u0141KA KOMANDYTOWO-AKCYJNA with its registered office in Bukowina Tatrza\u0144ska, ul. Ko\u015bciuszki 94, 34-530 Bukowina Tatrza\u0144ska, KRS: 0000929690, NIP: 7361738044, REGON: 520303494 (hereinafter: &#8220;Controller&#8221; or &#8220;Service Provider&#8221;). <\/li>\n\n\n\n<li>The Application is intended exclusively for customers of the Schronisko Bukowina restaurant, located at the address indicated in paragraph 2, and applies exclusively to this single catering establishment. <\/li>\n\n\n\n<li>These Regulations constitute an agreement for the provision of services by electronic means within the meaning of the Act of 18 July 2002 on the provision of services by electronic means. <\/li>\n\n\n\n<li>Using the Application requires familiarization with and acceptance of the Regulations.<\/li>\n<\/ol>\n\n<h2 class=\"wp-block-heading\">\u00a72. Definitions <\/h2>\n\n<p class=\"wp-block-paragraph\">For the purposes of these Regulations, the following terms shall have the meanings ascribed to them:<\/p>\n\n<ol class=\"wp-block-list\">\n<li>Application \u2013 the &#8220;Schronisko Bukowina&#8221; mobile application.<\/li>\n\n\n\n<li>User \u2013 a natural person who is at least 13 years old and uses the Application. <\/li>\n\n\n\n<li>Account \u2013 an individual User account created in the Application.<\/li>\n\n\n\n<li>Discount \u2013 a permanent or temporary right to reduce the price of selected products or the restaurant&#8217;s offer.<\/li>\n\n\n\n<li>Manager \u2013 a person authorized by the Controller to perform a one-time verification of the User and to grant or revoke status and Discounts.<\/li>\n\n\n\n<li>Waiter \u2013 a restaurant employee authorized to continuously verify the User&#8217;s eligibility for Discounts during subsequent visits, using a one-time code displayed in the Application.<\/li>\n<\/ol>\n\n<h2 class=\"wp-block-heading\">\u00a73. Scope of Services <\/h2>\n\n<ol class=\"wp-block-list\">\n<li>Through the Application, the Controller provides Users with services consisting of:<br\/>a) enabling the creation and maintenance of an Account,<br\/>b) granting and managing Discounts,<br\/>c) presenting the current menu, information about events, opening hours, and the restaurant&#8217;s offer,<br\/>d) sending push and SMS notifications \u2013 after separate consent is given.<\/li>\n\n\n\n<li>The Application does not allow placing orders or making payments.<\/li>\n\n\n\n<li>The information presented in the Application is for informational purposes only. A binding commercial offer is valid only at the restaurant premises. <\/li>\n<\/ol>\n\n<h2 class=\"wp-block-heading\">\u00a74. Registration and Account <\/h2>\n\n<ol class=\"wp-block-list\">\n<li>Creating an Account is voluntary, but necessary to use Discounts.<\/li>\n\n\n\n<li>Registration takes place by:<br\/>a) providing the required data,<br\/>b) accepting the Regulations,<br\/>c) creating an Account in the Application.<\/li>\n\n\n\n<li>The Account is active immediately after registration.<\/li>\n\n\n\n<li>One phone number can be assigned to only one Account.<\/li>\n<\/ol>\n\n<h2 class=\"wp-block-heading\">\u00a75. Discounts and User Status <\/h2>\n\n<ol class=\"wp-block-list\">\n<li>The Application allows the use of various types of Discounts.<\/li>\n\n\n\n<li>The first Discount is granted once after verification by the Manager.<\/li>\n\n\n\n<li>After the initial verification, subsequent confirmations of eligibility for a Discount during subsequent visits are made by the Waiter scanning a one-time code displayed in the User&#8217;s Application.<\/li>\n\n\n\n<li>The one-time code is temporary and is used solely for current verification of Discount eligibility.<\/li>\n\n\n\n<li>To use a Discount, the User presents the Application to the restaurant staff.<\/li>\n\n\n\n<li>During subsequent visits, eligibility for a Discount is verified by the Waiter by scanning a one-time code displayed in the User&#8217;s Application.<\/li>\n\n\n\n<li>In case of no internet access, application malfunction, or inability to generate a one-time code, the User may be asked to present a physical card entitling them to the Discount.<\/li>\n\n\n\n<li>The technical inability to use the Application does not constitute grounds for claims against the Controller.<\/li>\n<\/ol>\n\n<h2 class=\"wp-block-heading\">\u00a76. User Obligations <\/h2>\n\n<p class=\"wp-block-paragraph\"><br\/>1. In case of no internet access or application malfunction, the User may be asked to present a physical card entitling them to the Discount.<br\/>2. The technical inability to use the Application does not constitute grounds for claims against the Controller.<\/p>\n\n<ol class=\"wp-block-list\">\n<li>The User is obliged to use the Application in accordance with the Regulations and applicable legal provisions.<\/li>\n\n\n\n<li>It is forbidden to:<br\/>a) share Discounts with third parties,<br\/>b) use another person&#8217;s Account,<br\/>c) provide false data.<\/li>\n<\/ol>\n\n<h2 class=\"wp-block-heading\">\u00a77. Account Deletion and Blocking <\/h2>\n\n<ol class=\"wp-block-list\">\n<li>The User can delete the Account at any time.<\/li>\n\n\n\n<li>The Controller may block or delete an Account in case of violation of the Regulations or abuse.<\/li>\n<\/ol>\n\n<h2 class=\"wp-block-heading\">\u00a78. Liability <\/h2>\n\n<ol class=\"wp-block-list\">\n<li>The Controller allows for temporary interruptions in the operation of the Application caused by technical work or malfunctions.<\/li>\n\n\n\n<li>The Controller is not liable for damages resulting from lack of access to the Application if Discounts can be redeemed in another way, in accordance with \u00a76.<\/li>\n<\/ol>\n\n<h2 class=\"wp-block-heading\">\u00a79. Complaints <\/h2>\n\n<ol class=\"wp-block-list\">\n<li>Complaints regarding the operation of the Application can be submitted electronically to: manager@schroniskobukowina.pl.<\/li>\n\n\n\n<li>Complaints are processed within 14 days.<\/li>\n<\/ol>\n\n<h2 class=\"wp-block-heading\">\u00a710. Personal Data <\/h2>\n\n<p class=\"wp-block-paragraph\">The rules for personal data processing are defined in the Privacy Policy available in the Application.<\/p>\n\n<h2 class=\"wp-block-heading\">\u00a711.
